Welcome to BeAbstrakt Photography LLC! These terms and conditions outline the rules and regulations for using our photography services.

Please read these terms carefully before booking or using our services. By accessing or using our services, you agree to be bound by these terms and conditions.

 

Services:

1.1 BeAbstrakt Photography LLC offers a range of photography services, including but not limited to portrait photography, event photography, product photography, and photo editing.

1.2 Our services are available for individuals, businesses, and organizations, subject to availability and our discretion.

 

Bookings and Payments:

2.1 To book our photography services, you must contact us through our designated channels, such as our website, email, or phone.

2.2 A booking will only be confirmed upon receipt of a non-refundable booking fee, as determined by BeAbstrakt Photography LLC.

2.3 The remaining balance for the services must be paid in full prior to or on the day of the scheduled photography session, unless otherwise agreed upon in writing.

2.4 Failure to pay the balance may result in cancellation of the booking.

 

Cancellation and Rescheduling:

3.1 If you need to cancel or reschedule a photography session, please notify us in writing as soon as possible.

3.2 Cancellations made less than 48 hours before the scheduled session may result in the loss of the booking fee.

3.3 BeAbstrakt Photography LLC reserves the right to cancel or reschedule a session due to unforeseen circumstances, such as extreme weather conditions, illness, or equipment failure. In such cases, we will make reasonable efforts to reschedule the session or provide a full refund of any fees paid.

 

Intellectual Property and Usage Rights:

4.1 BeAbstrakt Photography LLC retains the copyright and ownership of all photographs taken during the photography session, including those provided in digital or printed form.

4.2 Clients are granted a limited, non-exclusive, and non-transferable license to use the photographs for personal or business purposes, as agreed upon in writing.

4.3 Clients must not alter, modify, or reproduce the photographs without prior written consent from BeAbstrakt Photography LLC.

4.4 BeAbstrakt Photography LLC reserves the right to use the photographs for promotional and marketing purposes, including but not limited to website display, social media, portfolio, and competitions. However, we respect your privacy and will not use sensitive or private images without your explicit consent.

4.5 Be Abstrakt Photography does not need to wait exclusively for the client to inform of when photos can be posted on digital or social platforms or print artwork. The photographer can display artwork at their discretion in any time frame

4.6 NDA's are accepted, please reach out to us via email for NDA Disclosure.  

 

Client Responsibilities:

5.1 Clients are responsible for providing accurate and complete information regarding their photography needs, including the date, time, location, and any specific requirements. 5.2 Clients should arrive at the agreed-upon location on time and be ready for the photography session. 5.3 Clients are responsible for obtaining any necessary permissions, permits, or releases required for the photography session, including but not limited to location permits, model releases, and property releases.

 

Liability and Indemnity:

6.1 BeAbstrakt Photography LLC will exercise reasonable care and skill in capturing and delivering the photographs. However, in the event of unforeseen circumstances or technical failures, our liability is limited to a refund of fees paid.

6.2 Clients release BeAbstrakt Photography LLC and its representatives from any liability for any loss, damage, or injury that may occur during the photography session or as a result of the use of the photographs.

6.3 Clients agree to indemnify and hold harmless BeAbstrakt Photography LLC against any claims, costs, and expenses arising from their use or misuse of the photographs or any breach of these terms and conditions.

 

Governing Law and Jurisdiction:

7.1 These terms and conditions are governed by the laws of the jurisdiction in which BeAbstrakt Photography LLC operates.

7.2 Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

 

Amendments:

8.1 BeAbstrakt Photography LLC reserves the right to modify or amend these terms and conditions at any time, without prior notice.

8.2 Any changes to these terms and conditions will be effective immediately upon posting the updated version on our website or other communication channels.

8.3 It is your responsibility to review these terms and conditions periodically to stay informed of any changes. By booking or using our services, you acknowledge that you have read, understood, and agreed to these terms and conditions. You also agree to the deliverables of any package that was selected for your photography session.

 

In full understanding, our products and services are NON REFUNDABLE. You fully agree to not file any chargebacks with your bank, credit or debit card or form of payment used to pay for photography services with Be Abstrakt Photography LLC. Due to the nature of our product (Artwork) in Digital Form may NOT be returned or refunded in any instance.
